What information we collect
The information we collect depends on your enquiry or order. It may include:
- your name, telephone number and email address;
- your address, venue or delivery details where relevant;
- the date, guest numbers and other details of your event;
- details of the food, buffet or cake you would like;
- names, ages, themes or other information you ask us to include in a personalised order;
- information about dietary requirements, allergies or health conditions where relevant to your order;
- payment records, such as the amount, date, reference and method of payment;
- correspondence with you, including enquiries, feedback, complaints or claims; and
- photographs you send to us, or photographs of an order where they contain personal information.
When you use our website, our website or hosting provider may also process limited technical information, such as IP addresses and server logs, where this is necessary to operate and protect the website.
How we use your information
We use personal information to:
- respond to enquiries;
- discuss your requirements and provide quotations;
- plan, prepare, supply and, where appropriate, deliver your order;
- communicate with you about your order;
- receive and record payment;
- keep appropriate business and accounting records;
- deal with questions, complaints or legal claims; and
- operate and protect the website and our business.
Our lawful bases
We must have a lawful basis for using personal information.
For most customer information, we rely on contract where the information is needed to take steps at your request before an order is agreed or to fulfil an order you have placed with us.
We may rely on a legal obligation where we need to keep or use information to comply with the law, including tax and accounting requirements.
We may also rely on our legitimate interests where necessary for the reasonable operation and protection of RH Catering, including dealing with enquiries, complaints and possible legal claims, provided those interests are not overridden by your rights.
Allergies and health information
Information about allergies, health conditions or medically-related dietary requirements can be special-category personal information and receives additional protection under data protection law.
Where you give us this information because it is relevant to an order, we will use it only for the purpose of discussing, preparing or managing that order. Where required, we will rely on your explicit consent to use this information.
You can withdraw that consent at any time. However, if the information is necessary for us to fulfil your order safely, withdrawing consent may mean that we are unable to continue with the order.
If an incident, complaint or legal claim arises, we may retain relevant information where this is necessary to establish, exercise or defend legal claims.
Information about children
The RH Catering website is intended for adults arranging catering or cake orders.
We may nevertheless receive limited information about a child, such as their first name, age, preferences or relevant allergy information, where an adult provides it in connection with an order.
We use that information only as necessary to fulfil the order and do not use it for unrelated purposes.
Information about other people
If you provide personal information about somebody else, please make sure that you are entitled to give that information to us and, where necessary, have their permission to do so.
Where we get information from
We usually receive personal information directly from you.
We may also receive information from somebody making an enquiry or placing an order on your behalf.
Who we share information with
We do not sell personal information.
We may share information where reasonably necessary with:
- website, email and other IT service providers;
- accountants or other professional advisers;
- suppliers or service providers involved in fulfilling an order where necessary; and
- HMRC, regulators, courts or other public authorities where disclosure is required by law.
Where a service provider processes personal information outside the UK, we will ensure that an appropriate safeguard or transfer mechanism is used where required by data protection law.
How long we keep information
We do not keep personal information for longer than we reasonably need it.
- Enquiries that do not become orders: normally for up to 12 months after our last contact.
- Order, invoice, payment and other business records: normally for up to six years, or longer where necessary to comply with tax requirements, an HMRC enquiry or another legal obligation.
- Allergy or other health-related information: normally deleted as soon as reasonably practicable after the relevant order, usually within 30 days, unless an incident, complaint or other reason means that it needs to be retained.
- Complaints and claims: for as long as reasonably necessary to resolve the matter and, where relevant, to establish, exercise or defend legal claims.
Your data protection rights
Depending on the circumstances, you may have the right to:
- ask for a copy of your personal information;
- ask us to correct inaccurate or incomplete information;
- ask us to delete personal information;
- ask us to restrict how information is used;
- object to certain uses of your information;
- receive certain information in a portable format; and
- withdraw consent where we rely on consent.
Not every right applies in every situation.
To exercise any of your data protection rights, please contact Rebecca using the contact details above.
